PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE
1. Format of the Contract 1.1 These terms of sale apply to all goods supplied by Ideal Computing.co.uk Limited, whose registered office is at 78 Bruntsfield Place Edinburgh EH10 4HG (the "Supplier"). 1.2 No contract exists between you and the Supplier for the sale of any goods until the Supplier has received and accepted your order and the Supplier has received payment in full (in cleared funds). Once the Supplier does so, there is a binding legal contract between us. To order goods from the supplier you must be at least 18 years of age. 1.3 By way of clarification, an acknowledgement of your order will be sent to you via e-mail when you place your order, but acceptance of your offer to buy the goods will not take place until after your payment is taken. It is at this point that a binding legal contract is created and any contract is subject to these Terms and Conditions. 1.4 The contract is subject to your right of cancellation (see below). 1.5 The Supplier may change these terms of sale without notice to you in relation to future sales.
1. In order to properly log and respond to your request, you must obtain a Return of Merchandise Authorisation Number (RMA) prior to returning the product. To obtain this RMA number, please contact our Technical Support Department by completing the RMA form or call the Technical Support Hotline on 0871 7000 151 (Mon-Sat, 10am-5pm)
2. In order to expedite a resolution to your problem, we may occasionally refer you to the product manufacturer who will deal directly with the return. In these instances, we will provide you with the contact information for the relevant manufacturer. These are also available on our Links section of the website.
3. Products found to be faulty within 14 days of being supplied will only be refunded if they are returned to us in their original condition. This means that all the items included in the original shipment including manuals, cables, disks, any software items, and any other items relating to that product must be included.
4. We cannot accept liability for packages damaged during transit so we advise you to wrap the product adequately to prevent this happening.
5. The RMA Number must be clearly marked on the outside of the wrapping, otherwise it may be refused. Please do not write directly on to retail boxes. It will also help us to process your return quicker if you enclose a detailed note of the fault.
6. Our Technical Support staff will advise you of which method of delivery to use to return the products. Depending on the nature of the product purchased, we will either arrange a courier collection of the product, or request that you return the product to us directly. Components are covered by a Return to Base warranty and therefore all carriage costs will be paid for by the customer.
• Note: If we have arranged for a courier collection of your product, we are unable to specify the collection time, and will require someone to be present when the courier comes. Should you not be available for collection of the goods in question, then you will be liable for any courier costs incurred for collection failures due to the customer.
• In the situation where idealcomputing are liable for the carriage cost for goods being returned to us, our maximum liability will be £6.94 inc. VAT.
• If we ask you to return it to us directly, please send it to the address below. Proof of postage is not necessarily proof of delivery and you are therefore strongly advised to send your package by recorded delivery, registered post or courier and to maintain sufficient insurance to cover the value of the goods.

8. On receipt of the return, we will test the product according to the fault you have stated. If the product is found to be in good working order without defect, we will return the product to you. We shall be entitled to charge you a ‘No Fault Found’ fee of £10 ex VAT and for the return carriage costs via your original payment method. In the event that your credit card has expired is declined or any other payment method is not available we will hold the item(s) until full payment has been made for the 'No Fault Found' fee and return carriage. For UK delivery the return carriage will not be more than £6 ex VAT. For returns from outside of the UK we will advise you at the time of issuing the RMA.
9. Returned products requiring a test are handled by our Technical Support Department. The product will be extensively tested for the fault according to the manufacturer's testing guidelines and if the fault is confirmed, we will replace the product. However, this process can take up to 14 days to complete so please be patient.
For return of unwanted products
1. This offer excludes CPUs, memory & hard drives, software, PC’s and any customized products. This is because of the volatile pricing of memory, CPUs and Hard Drives and the static-sensitive nature of such products, ie. easily damaged due to improper handling without the correct anti-static precautions being taken. Software cannot be returned in line with Anti-Piracy Laws. PCs and customised products are built to order and to customer specification and are therefore not covered by this offer.

3. Unwanted products that are returned to us will only be accepted if they are in an uncompromised and re-saleable condition, and within 7 working days of delivery. Ideal Computing does not sell goods on a trial basis.

However, returns cannot be accepted without the issued RMA Number clearly marked on the packaging.
6. Carriage fees in these instances are not refundable.
7. An administration fee totalling 10% of order value will apply to unwanted products returned to idealcomputing after 7 working days. This covers administration and subsidies given by us to our customers, ie. credit card surcharge. Returned products have to be in the condition in which they were originally supplied.
8. These terms do not affect your statutory rights.

2. Description and price of the goods
2.1 The description and price of the goods you order will be as shown on the Supplier's website at the time you place your order. Our staff cannot offer advice. You must confirm compatibility eg. by checking manufacturers sites. 2.2 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock or from manufacturer, the Supplier will inform you as soon as possible and refund or re-credit you for any sum that has already been paid by you or debited from your credit/debit card for the goods. 2.3 Every effort is made to ensure that prices shown on the Supplier's website are accurate at the time you place your order. If an error is found, the Supplier will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order. If the Supplier does not receive an order confirmation within 14 days of informing you of the error, the order will be cancelled automatically. If you cancel, the Supplier will refund or re-credit you for any sum that has been paid by you or debited from your credit/debit card for the goods. 2.4 In addition to the product price(s), you may be required to pay a delivery charge for the goods.
3. Payment
3.1 Payment for the goods and delivery charges can be made by any method shown on the Supplier's website at the time you place your order. Payment shall be due before the delivery date and time for payment shall be of the essence. 3.2 There will be no delivery until cleared funds are received. 3.3 Payments shall be made by you without any deduction whether by way of set-off, counterclaim, discount, abatement or otherwise unless you have a valid court order requiring an amount equal to such deduction to be paid by the Supplier to you.
4. Delivery
4.1 Ideal Computing have enabled the Verified by Visa and MasterCard SecureCode systems in the Checkout process. When placing your order by Visa or MasterCard, you can now have the order delivered to your work or friends address if you are not going to be available to accept the parcel. When you reach the 'Secure Order Form', insert the address you would like the order to be delivered to. 4.2 Orders (excluding computer systems) placed before 4.00 pm on a working day will be processed that day and will be delivered as per the requested delivery option provided no additional security checks are required and all stock items are available. (A working day is any day other than weekends and bank or other public holidays.) 4.3 If delivery cannot be made to your address for reasons out with the Supplier's control the Supplier will not be liable for any losses, costs, damages, charges or expenses caused by any delay for delivery of the goods. 4.4 If you deliberately fail to take delivery of the goods then without prejudice to any other right or remedy available to the Supplier, the Supplier may: 4.4.1 store the goods until actual delivery and charge you for reasonable costs (including insurance) of storage; or 4.4.2 sell the goods at the best readily obtainable price and (after deducting all reasonable storage and selling expenses) account to you for any excess over the price you agreed to pay for the goods or charge you for any shortfall below the price you agreed to pay for the goods. 4.5 If you fail to take delivery because you have cancelled your contract under the Distance Selling Regulations the Supplier shall refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit/debit card for the goods, less any expenses incurred for failed delivery. 4.6 Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, the Supplier will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, the Supplier will inform you as soon as possible. 4.7 Time for delivery shall not be of the essence. The goods may be delivered by the Supplier in advance of the quoted delivery date. 4.8 Upon receipt of your order you will be asked to sign for the goods received in good condition. Where goods seem to have suffered external damage, it is in your interest to refuse delivery or inspect the goods on arrival.
5. Risk/Title
5.1 The goods are at your risk from the time of delivery 5.2 Ownership of the goods shall not pass to you until the Supplier has received in full (in cash or cleared funds) all sums due to it in respect of: 5.2.1 the goods, and 5.2.2 all other sums which are, or which become due to the Supplier from you on any account. 5.3 The Supplier shall be entitled to recover payment for the goods notwithstanding that ownership of any of the goods has not passed from the Supplier.
6. Your right of cancellation
6.1 You have the right to cancel the contract at any time up to the end of 7 working days after you receive the goods. 6.2 To exercise your right of cancellation, you must give written notice to the Supplier by letter, fax or e-mail, at the fax number or e-mail address shown below, giving details of the goods ordered, invoice number, date of order. 6.3 If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to the Supplier at your own cost. Goods are not supplied on a trial basis. The goods must be returned in a sellable condition. To the address shown below. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit. 6.4 Once you have notified the Supplier that you are cancelling the contract, the Supplier will refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit/debit card for the goods. 6.5 If you do not return the goods as required, the Supplier may charge you a sum not exceeding the direct costs of recovering the goods. 6.6 You do not have the right to cancel the contract if the order is for computer software which has been unsealed by you; for consumable goods which, by their nature cannot be returned; RAM and CPU chips due to their volatile pricing nature. 6.7 All computer systems are custom assembled for each and every customer. Therefore a cancellation prior to delivery will incur a standard charge of 10% of the complete order value.
7. Warranty
7.1 All goods supplied by the Supplier over the value of £30 are warranted free from defects for 12 months from the date of supply (unless otherwise stated). Consumables carry no such warranty. Software be it on original media or installed on a computer, carries no warranty. This warranty does not affect your statutory rights as a consumer. 7.2 This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the Supplier, failure to follow the Supplier's instructions, or any alteration or repair carried out without the Supplier's approval. 7.3 If the goods supplied to you are damaged on delivery, you should notify the Supplier in writing via the e-mail address or fax number shown below within 24 hours. Our customer services department will arrange collection of these goods and we will replace the goods at no charge. IF YOU DO NOT DO THIS WE SHALL HAVE NO LIABILITY FOR GOODS SAID TO BE DAMAGED ON DELIVERY. If the goods returned under this clause are found to be in full working order then these will be returned to you and an administration fee of 15% of the price of the goods, or £25, whichever is the greater amount, along with the complete cost of carriage will be charged to you. 7.4 Shortages must be reported within 24 hours of goods being received. Notification preferably to be made by email. IF YOU DO NOT DO THIS WE SHALL HAVE NO LIABILITY FOR GOODS SAID TO BE MISSING ON DELIVERY. 7.5 If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods you should notify in the first instance the manufacturer (contact details can be found at: Links Page ) for replacement. Technical support can be obtained directly from manufacturers. The supplier provides no technical support. Any products not covered by a manufacturers' warranty comes with a one-year return to base warranty unless otherwise stated. This warranty is non-transferable to another person or product, e.g. where an original item has failed, and the company has replaced that product with another. Software related issues are not covered by this warranty.
8. Limitation of Liability
8.1 the Supplier's total liability in contract, Delict (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this agreement shall be limited to the price paid for the goods. 8.2 Nothing in these conditions excludes or limits the liability of the Supplier for death or personal injury caused by the Supplier's negligence or fraudulent misrepresentation. 8.3 If you are a business customer the Supplier shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this agreement.
9. Data Protection
The Supplier will take all reasonable precautions to keep the details of your order and payment secure but unless the Supplier is negligent, the Supplier will not be liable for unauthorised access to information supplied by you.
10. Applicable Law
The laws of Scotland shall govern the contract between us, and any dispute will be resolved exclusively in the courts of Scotland. We operate a complaints handling procedure, which we will use to try to resolve disputes when they first arise. If you have a complaint contact us at customercare@ideal-computing.co.uk. All complaints will be handled in a confidential manner. A member of the customer services department will contact you as soon as possible to acknowledge receipt of your complaint. You will receive a response to your complaint within 7 days. This response will be in email. These terms and conditions are subject to change at any time without prior notice to you. These terms and conditions were last updated on 19th August 2004. All proceeding updates will supersede this document.
We advise you to print and keep safe a copy of these Terms and Conditions.
